Open Space Farm and Agriculturual Conservation
To be considered for
Open Space Farm & Agricultural Conservation Land, the
property must be:
- Land previously classified under Farm and Agriculture
Conservation classification that no longer meets the criteria
and is reclassified under Open Space land; or
- Traditional farmland, not classified, that has not
been irrevocably devoted to a use inconsistent with agricultural
uses, and that has a high potential for returning to commercial
agriculture.
All lands must have public access which is defined as the
right of any individual to request permission to enter and
visit the premises on foot for legitimate recreational purposes
such as bird watching, scenic observation, scientific investigation,
picnicking during daylight hours, and strolling and general
relaxation on the premises. This right is subject to the
execution by the visitor of an agreement to abide by any reasonable
rules of personal conduct required by the owners.
There are no acreage or income requirements for Open Space
Farm and Agricultural Conservation lands.
As a condition of approval, you must post a 2 x 2 foot sign
on the property to indicate Open Space status and public access.
However, public access may not be required if the property
contains sensitive habitat or wildlife (RCW 84.34.020(c).)
You will be required to sign a Hold Harmless Agreement in
which you agree to defend and hold harmless Whatcom County
in any claim which may arise.
